AMENDMENT TO PROCLAMATION OF A STATE OF EMERGENCY
The Board of Commissioners amend the Proclamation of a State of Emergency as follows:
The Board of Commissioners has determined that within the “Affected Area” created by the Tropical Storm Fred flash flood in the Cruso/Bethel/Canton areas of Haywood County there is a risk to persons coming into the area during the late night due to disruptions of roads. As well, the entry of non-resident persons to the area has resulted in some thefts from damaged homes in the area.
The protection of persons and property in the Affected Area necessitates the imposition of a late-night curfew within the Affected Area, from the hours of 10:00 p.m. to 6:00 a.m., seven days a week, until this emergency declaration is amended or rescinded.
The Affected Area is generally defined as being bounded by NC Highway 110 at Max Thomson Road to US 276 and NC 110 and any area Southeast of NC 110. The Affected Area shall also be any area beyond any roadway access control points established by “Road Closed” signs posted by the NC Department of Transportation, by the Haywood County Sheriff, or by Haywood County Emergency authorities.
The general dimensions of the Affected Area are shown on the attached sketch map.
Unless a member of a law enforcement agency or the emergency management program, every person who is located within the Affected Area is to be inside a house dwelling from the hours of 10:00 p.m. to 6:00 a.m.
All persons and vehicles are prohibited from passing on the roads in the Affected Area during the curfew hours except emergency personnel and equipment and persons going to and from work or any person needing or seeking emergency or medical attention.
I hereby order all law enforcement officers and employees and all other emergency personnel subject to my control to cooperate in the enforcement and implementation of the provisions of the county emergency ordinances which are set forth below.
Persons violating the curfew will be subject to N.C.G.S. §166A-19.31. Any person who violates any provision of this declaration shall be guilty of a Class 2 misdemeanor in accordance with G.S. 14-288.20A.
NOW, THEREFORE, pursuant to the authority contained in Article IA of N.C.G.S. § Chapter 166A, Article 36A of N.C.G.S. § Chapter 14, and Chapter 31 of the Haywood County Code of Ordinances, I, Chairman L. Kevin Ensley of the Haywood County Board of Commissioners, does hereby proclaim that a State of Emergency exists within Haywood County.
The restrictions and prohibitions set forth in this Amended Proclamation of a State of Emergency shall be effective within the set forth area within Haywood County, North Carolina beginning on this 25th day of August, 2021 and shall remain in effect until further notice.
I hereby order all law enforcement officers and employees and all other emergency personnel subject to our control to cooperate in the enforcement and implementation of the provisions of this Amended Proclamation, all applicable local ordinances, state and federal laws, and the Haywood County Emergency Operations Plan.
I direct that copies of this amended Proclamation be disseminated to mass communications media for publication and broadcast, and that a copy of this amended Proclamation be posted in the County Manager's Office, on the Haywood County website and distributed to others as necessary to ensure proper implementation of this amended Proclamation.
This Amendment to the Proclamation shall be effective as of 10:00 p.m. on August 25, 2021 and shall remain in effect unless rescinded pursuant to Chapter 31 of the Haywood County Code of Ordinances.
